DMCA Notification Guidelines
FileSonic (www.FileSonic.com) is an Internet Service Provider under Title II of the Digital Millennium Copyright Act, 17 U.S.C. Section 512 ("DMCA"). The following is an outline of FileSonic's policies in relation to notices and takedown notices as required by the DMCA. The following applies to any and all copyright/trademark and owners of intellectual property interested in utilizing this procedure, as well as service users interested in restoring access to material mistakenly taken down.
The DMCA provides a legal procedure by which you can request any Internet Service Provider to disable access to a website where your copyrighted work(s) are appearing without your permission/authorization. The legal procedure consists of two parts: (1) Completing a Proper DMCA Notice, and (2) Sending the Proper DMCA Notice to FileSonic.com's Designated DMCA Agent.
To complete a proper DMCA Notice, state the following information:
- Identify yourself as an owner of copyrighted work or exclusive rights that you believe were infringed, or a person acting on behalf of such owner.
- Provide information reasonably sufficient to permit FileSonic.com to contact you namely, your contact information: name, address, phone number, and email address.
- Identify the copyrighted work that you believe is being infringed, or if a large number of works are being infringed, a representative list of the works.
- Identify the location of materials that allegedly are infringing your copyrighted work, by providing Web URLs on FileSonic.com site that contain these materials. Please don't send attached images, pdf or other file formats files, but only list with FileSonic.com web urls. Providing URLs in the body of an email is the best way to help us locate content quickly.
- State that you have "a good faith belief that use of the aforementioned material is not authorized by the copyright owner, its agents, or the law".
- State that the information in the notice is accurate, under penalty of perjury. To do so, include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the (copyright) owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
- Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.
- Sign the notice. If you are providing notice by e-mail, a scanned physical signature or a valid electronic signature will be accepted.
- To expedite our ability to process your request, such written notice should be sent to our designated agent along with your Proper DMCA Notice must be sent to Designated Agent of FileSonic.com to: dmca@filesonic.com
Notice and takedown procedure
FileSonic.com will follow the procedures provided in the DCMA to properly enforce rights of copyright holders. When a Proper DMCA notification is received by the Designated DMCA Agent, or when FileSonic.com becomes otherwise aware that copyright rights are infringed, it will remove or disable access to infringing materials as soon as possible. FileSonic.com will not necessarily send a confirmation regarding the removal/disabling.
Counter Notification
If users submitting or downloading materials believe that their use of materials was lawful, they have the right of sending a Proper Counter-notification in order to restore access to these materials. FileSonic.com will comply with the appropriate provisions of the DMCA in the event a counter notification is received by its Designated Agent.

Repeat Infringer Policy
FileSonic will, in appropriate circumstances, terminate repeat infringers. If you believe that an account holder or subscriber is a repeat infringer, please follow the instructions above to contact FileSonic and provide information sufficient for us to verify that the account holder or subscriber is a repeat infringer.
Reporting Abuse
FileSonic has a zero tolerance approach towards abusive content/files. To report abuse in relation to content, files or the site please email abuse@filesonic.com with a brief summary/description of the issue at hand. Abusive files will be deleted within hours after your notice.
